Purchase and trade-in terms
These terms apply when you ask GPU Sold to buy a graphics card or other listed component (the “Item”). They control over marketing copy. If they conflict with the Website Terms, these win for the purchase.
1. You must own it
You represent that you are 18+, the sole owner, the Item is not stolen, leased, financed with an outstanding lien you have not disclosed, or subject to a recall that makes it unlawful to sell, and that you have the right to transfer clear title. We may require government ID, a serial photo, and a signed bill of sale. We report suspected stolen property to law enforcement and may hold the Item without payment.
2. Quotes are not a contract
On-site numbers are estimates based on recent sold listings and your answers. A contract starts only when (a) we issue a locked offer ID, (b) you accept it, and (c) we later accept the Item after inspection. We can refuse any Item for any lawful reason, including thin comps, a frozen SKU, or operational limits.
3. Locked offers
A locked offer is good for 72 hours unless the page says otherwise. It dies if you do not ship in that window, if the Item is not the SKU you selected, or if the market window we use is frozen under our published rules. We do not guarantee we can honor a lock if you materially misdescribed the Item.
4. Condition is your job
“Working” means the card powers on, initializes, outputs a stable image on at least one port, passes a short artifact and temperature check on our bench, and matches the photos. Open box means unused or like-new with retail packaging. Damaged means it still displays but has broken shrouds, bent fins, missing brackets, or similar. Water-cooled, laptop, mined-untested, and “for parts” Items are outside a standard lock unless we say so in writing.
5. Inspection is the real close
Title and risk stay with you until we email that the Item passed and payment is released. We may open the cooler, check serials against photos, and run stress tests. We photograph and may record the bench. Those records are our evidence if you later dispute the outcome.
6. Revised offers — silence is not yes
If the Item fails or does not match, we may (i) reject and return it, (ii) recycle it only with your written OK, or (iii) send a lower revised offer. You have five calendar days to accept or reject by email. If you do not answer, we treat that as a rejection and return the Item to the address you gave, not as acceptance of less money. One free return attempt on a good-faith mismatch. After that, storage or return shipping can be charged against any amount we owe you.
7. Payment
We pay after a pass, by the method we agree (typically ACH, Zelle, or PayPal Goods). We may hold payment up to seven business days for a first-time seller or a high-value Item. You are responsible for your processor’s holds, your taxes, and any 1099 we are required to issue. We do not pay for stolen, counterfeit, or empty-box shipments.
8. Chargebacks and clawback
If a payment is reversed, the Item was not as described, or we later find the serial was swapped, you owe the amount paid plus our reasonable recovery costs. We may offset future deals.
9. No consumer loan, pawn, or consignment
This is an outright sale if we accept the Item. We are not a pawnbroker, not holding the Item as collateral, and not selling on your behalf. You cannot demand the Item back after payment without a separate written buyback.
10. Photos and license
You grant us a non-exclusive license to use photos and serials you send to evaluate the deal and to defend disputes. We will not use your face or home interior in ads without a separate OK.
11. Liability for a deal
If we buy the Item, our liability to you is capped at the amount we actually agreed to pay for that Item. We are not liable for your lost upgrade window, eBay fees you did not avoid, or market moves after you ship.
12. Prohibited Items
We do not buy Items we reasonably believe are stolen, export-controlled without paperwork, hazardous (including swollen batteries attached to a card), or counterfeit. Sending those is a material breach.
13. State secondhand laws
Some cities and states require a secondhand-dealer or precious-metals-style license, police holds, or serial reporting when buying used electronics. We may pause purchases in your ZIP until those rules are met. That is not a waiver of any requirement that applies to you as the seller.
